Terms of Service

1. Introduction

These Terms of Service ("Terms") constitute a legally binding agreement between you and StitchCraft ("we", "us", "our", or "Platform", domain crossstitchpatternmaker.app, operating under the trade name "StitchCraft"). These Terms govern your access to and use of the StitchCraft website, the online Studio, project management tools, and all associated products and services.

By accessing or using our service (whether you create an account or not), you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any part of these Terms, please do not use StitchCraft.

2. Service Description

StitchCraft provides dedicated pattern creation and craft design tools for makers and needlework enthusiasts:

• Core photo-to-chart conversion is free, unlimited, and requires no account. The core conversion engine transforming photographs into stitchable DMC floss charts runs completely offline inside your web browser. No registration or login is required, there is no cap on how many patterns you make or export, and your source photos and drafts remain in your browser's local IndexedDB database.
• Account services. Creating an account allows you to hold a credit balance, purchase subscription plans or credit packs, and retain cloud task records to retrieve your AI generation results.
• AI assisted creation tools. Generative AI features for creating or refining source artwork are optional value-added capabilities available exclusively to signed-in users (we do not advertise or provide anonymous guest trials for AI). Each AI task consumes a fixed 8 credits (corresponding to the Nano Banana 2 Lite model, 1K resolution, and a single image output).

StitchCraft is an independent software and pattern interface. We have no affiliation, endorsement, or exclusive partnership with any underlying AI model provider.

3. Accounts and User Obligations

You must be at least 13 years old (or the legal age of majority in your jurisdiction) to create a StitchCraft account. You are solely responsible for all activities occurring under your account, including safeguarding your credentials and access keys. You agree to provide accurate email details upon registration. If you notice any unauthorized access or security breach, notify us promptly at support@crossstitchpatternmaker.app.

We reserve the right to suspend or terminate accounts that seriously breach these Terms, abuse technical interfaces, attempt payment fraud, or engage in malicious activity.

4. Credits and Expiration Rules

Credits are the sole unit used to execute AI generation and image redrawing tasks within StitchCraft. Pricing is fixed and predictable: every generation costs exactly 8 credits, and the cost alongside your current balance is clearly displayed before you submit a run.

The issuance, expiration, and usage rules for credits are as follows:

• New registration bonus: When you register a new account, you receive 30 welcome credits, valid for 30 days from grant. At 8 credits per generation, a new account can complete up to 3 generation runs with 6 credits remaining. We do not advertise multiple free generations.
• One-time credit packs: Purchased credit packs remain valid for 180 days from the date of purchase. Any unspent credits from a pack automatically expire 180 days after purchase.
• Subscription plan credits: Monthly subscription credits are granted monthly and are valid for 1 month. Annual subscriptions receive their full yearly credit allowance in a single upfront grant upon purchase or renewal, valid for 1 full year (365 days). Unused subscription credits do not roll over into subsequent billing cycles.
• Indefinite preservation of legacy credits: In honor of historical commitments, legacy credits without an expiration date issued or purchased prior to this policy retain their original terms and are preserved permanently under backward-compatibility guarantees. No retroactive expiration will be applied.
• Consumption order (FIFO oldest-first): When you launch an AI run, credits are consumed on a first-to-expire basis: expiring subscription allowances are depleted before 180-day pack credits.
• Automatic refunds for technical failures: If an AI task experiences a technical failure, times out (exceeding 10 minutes without image delivery), or is cancelled by our system, the 8 credits consumed are automatically and fully returned to your account balance.
• No cash value: Credits do not constitute legal currency, e-money, or monetary balances and cannot be exchanged, transferred, resold, or redeemed for cash.

5. Subscriptions, Billing, and Cancellation

Our subscription plans (such as Pro and Creator) are charged in advance on a recurring monthly or yearly schedule, as detailed on our pricing page.

• Automatic renewal: Subscriptions automatically renew at the end of each billing cycle at the then-effective rate via your payment method on file, until cancelled. By subscribing, you authorize our payment processor to collect the applicable recurring charge.
• Cancellation: You may cancel future renewals at any time within your account billing settings. Cancellation prevents the subsequent charge; you retain access to features and your current billing cycle's credits until the end of that paid period.
• Price adjustments: If we adjust subscription pricing, the new rate will apply only starting with the next renewal period following advance notice.

6. Refunds and Support

We maintain a transparent and fair refund policy:

• If you are unsatisfied with a subscription or credit pack purchase, you may request a refund within 14 days of the transaction, provided the purchased credits have not been substantially consumed. Any credits already spent on completed AI runs will be deducted from the refunded sum.
• To request a refund, email support@crossstitchpatternmaker.app from the email address associated with your account, citing your order transaction ID. Our billing team typically reviews and processes verified requests within 3 business days.
• Nothing in this section limits mandatory statutory consumer cancellation or refund rights under your local jurisdiction's laws.

7. Your Content and Ownership

You retain full legal ownership and intellectual property rights in the photos you upload and the charts, color palettes, and exported PDF/PNG files you create with StitchCraft. StitchCraft asserts no ownership claims over your original photos or your generated pattern designs.

You grant us only the limited technical license necessary to operate the service: specifically, the right to host, cache, and transmit your input files strictly to deliver requested outputs, in compliance with our Privacy Policy.

Your Creative Freedom: Patterns you produce belong to you. You are free to stitch them, gift finished items, exhibit them publicly, sell finished tapestries, or sell your exported chart files commercially without paying any royalties, licensing fees, or attributing StitchCraft. However:

1. Output legality reflects input legality: if you convert artwork or photos you do not have rights to, you remain responsible for any third-party copyright infringement;
2. You may not resell, redistribute, or white-label the StitchCraft software or API service itself.

8. Intellectual Property

The StitchCraft name, logo, site visual design, Studio interface, software algorithms, and proprietary source code are protected by intellectual property laws and remain the exclusive property of StitchCraft.

DMC color match codes, fabric dimension calculations, and skein estimates are algorithmic approximations. Creators should verify thread shades against physical color cards before placing large material orders.

9. Acceptable Use and Prohibited Content

StitchCraft is dedicated to maintaining a wholesome, safe, and family-friendly craft community. You agree not to use StitchCraft's upload or AI tools to create:

1. Pornographic or sexually explicit material: Any explicit nudity, sexual acts, or non-consensual sexualized imagery;
2. Violence and gore: Extreme blood, mutilation, self-harm, or content promoting violent criminal acts;
3. Hate speech and harassment: Content attacking, demeaning, or dehumanizing individuals based on race, religion, ethnicity, gender, sexual orientation, or disability;
4. Child Sexual Abuse Material (CSAM): Any sexual depiction or exploitation of minors. We enforce strict zero tolerance: accounts are terminated immediately and reported to law enforcement;
5. Deepfakes and identity impersonation: Creating deceptive likenesses of real individuals or public figures without written authorization;
6. Intellectual property infringement: Uploading copyright-protected artwork, proprietary cartoon characters, or corporate logos without authorization.

Attempting to bypass content moderation filters using adversarial prompts or iterative workarounds constitutes a direct violation. Prohibited generations will be blocked without credit refund, and repeated violations will result in account closure.

10. AI Tools and Output Retention

Generative AI models operate probabilistically:

• Aesthetic variability: Generated outputs may vary in style or aesthetic feel and might not perfectly match your subjective vision. Completed tasks that successfully deliver an image are not refundable on subjective artistic grounds.
• Server retention of 30 days: Files and images produced by AI runs are retained on our servers for 30 days to allow retrieval, viewing, and download from your task history. After 30 days, server files are automatically and permanently purged. Creators are advised to download satisfactory images to local storage or convert them into local drafts within 30 days. Files already downloaded to your device or saved as local IndexedDB patterns are not affected by this server cleanup.

11. Privacy and Data Protection

Our data collection and privacy practices are governed by our Privacy Policy. Core chart conversions run offline in your browser without uploading your images; authenticated AI tasks process data solely to fulfill requested runs and maintain the 30-day temporary retrieval window.

12. Service Availability and Local Storage

While we strive to ensure reliable and continuous platform access, we do not guarantee uninterrupted or error-free operations. StitchCraft is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.

Please note: your saved projects and working drafts reside in your browser's local IndexedDB storage. Clearing your browser site data, operating in private/incognito browsing mode, or switching devices may cause unexported local drafts to be removed. Always use the export features to back up critical patterns to your local computer or cloud storage.

13. Limitation of Liability

To the fullest extent permitted by applicable law, StitchCraft and its operators shall not be liable for any indirect, incidental, punitive, consequential, or special damages, nor for loss of profits, business interruptions, or data loss arising from your use or inability to use the service.

14. Termination and Account Status

You may discontinue using StitchCraft at any time. Regarding account termination and sign-out, we commit to the following transparent policies:

• Signing out terminates the session only: Clicking "Sign out" only ends your active browser session; it does NOT delete or cancel your account or user data. Signing out does not forfeit credit balances, does not cancel active subscriptions, and does not delete local drafts stored in your browser.
• No account deletion button in settings: The account settings interface does not contain a self-service one-click account cancellation button. If you wish to delete your account permanently, purge server-side task logs, or request a complete export of your personal data under privacy laws, please email support@crossstitchpatternmaker.app, and our team will process your request manually upon identity verification.

15. Changes to These Terms

We may update these Terms from time to time. When changes are made, the revised version will be published here with an updated "Last updated" date.

For material changes affecting core service availability, pricing structures, credit validity terms, or major legal obligations, we will provide at least 14 days advance notice via on-site banners or direct email to registered users, and we will not make silent local modifications to avoid notification duties. Continued use of StitchCraft after revised terms take effect constitutes acceptance of those terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the operator's jurisdiction, without regard to conflict-of-law principles. Nothing in these Terms shall deprive you of statutory consumer protections guaranteed by the mandatory laws of your country of residence.
